These Terms of Service ("Terms") govern your access to and use of Clue Command ("Service," "we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

2. Description of Service

Clue Command is a cloud-based software platform designed for escape room businesses to manage game operations, including but not limited to:

• Game control and timer management
• Clue delivery and messaging systems
• Digital waiver collection and management
• Team photo capture and delivery
• Checklist management for room operations
• Leaderboard and reception TV displays
• Puzzle tracking and game analytics

3. Account Registration

3.1 Account Requirements

To use our Service, you must:

• Be at least 18 years of age or have parental consent
• Provide accurate, current, and complete information
• Maintain and update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

4. Subscription and Payment

4.1 Subscription Plans

We offer various subscription plans with different features and limitations. Subscription fees are billed in advance on a monthly or annual basis, as selected during signup.

4.2 Payment Terms

• All fees are in the currency specified at the time of purchase
• Fees are non-refundable except as required by applicable law
• We reserve the right to change our pricing at any time with reasonable notice
• Failed payments may result in immediate suspension or termination of your account
• You are responsible for all charges incurred, including any applicable taxes

4.3 Free Trial

We may offer a free trial period. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. All fees paid are non-refundable except as required by applicable law.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Transmit any harmful code, viruses, or malicious software
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service to collect or store personal data about other users without consent
• Impersonate any person or entity or misrepresent your affiliation
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems to access the Service without permission

6. User Content and Data

6.1 Your Content

You retain ownership of all content and data you upload to the Service ("User Content"). By uploading User Content, you grant us a license to use, store, and process it solely for the purpose of providing the Service.

6.2 Customer Data

You are responsible for ensuring that any customer data (including waiver information, photos, and personal information) collected through our Service is collected and processed in compliance with applicable data protection laws, including GDPR.

6.3 Data Backup

You are solely responsible for maintaining your own backups of all important data. While we may perform backups as part of our service operations, we do not guarantee the availability, completeness, or accuracy of any backups. We are not liable for any loss, corruption, or unavailability of data under any circumstances.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Clue Command and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service.

8. Service Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, continuous, or error-free operation of the Service. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time without prior notice
• Perform maintenance, updates, or modifications that may temporarily or permanently interrupt service
• Update, change, or remove features and functionality at our sole discretion
• Limit or restrict access to the Service for any reason

We shall not be liable for any downtime, service interruptions, or loss of functionality.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM

10. Indemnification

You agree to indemnify and hold harmless Clue Command, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content or data you submit through the Service

11. Termination

11.1 Termination by You

You may terminate your account at any time by canceling your subscription through your account settings or by contacting us.

11.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You fail to pay subscription fees
• We are required to do so by law

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and data after a reasonable retention period, except where we are required to retain it by law.

12. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. We may notify you of material changes by posting the updated Terms on this page, sending an email to your registered email address, or displaying a notice in the Service. However, we are not obligated to provide notice of all changes.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the Service and cancel your account.
